1. Acceptance of Terms
By accessing and using PMSoftware Services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Services Description
PMSoftware Services provides DevOps consulting, software development, infrastructure management, and related technical services. Our services include but are not limited to:
- Docker containerization and orchestration
- OAuth and authentication system implementation
- CI/CD pipeline development and management
- API development and integration
- Infrastructure setup and maintenance
- Security implementation and monitoring
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information necessary for service delivery
- Maintain the confidentiality of access credentials and system information
- Comply with all applicable laws and regulations
- Make timely payments as agreed upon in service contracts
- Provide reasonable access to systems and personnel as needed
4. Payment Terms
Payment terms will be specified in individual service agreements. Unless otherwise agreed:
- Invoices are due within 30 days of receipt
- Late payments may incur additional fees
- Services may be suspended for non-payment
- All prices are exclusive of applicable taxes
5. Intellectual Property
Unless otherwise specified in writing, all custom code, configurations, and documentation created specifically for your project will be owned by you upon full payment. PMSoftware Services retains rights to general methodologies, techniques, and know-how.
6. Confidentiality
We understand the sensitive nature of your business information and commit to maintaining strict confidentiality. We will not disclose your confidential information to third parties without your explicit consent, except as required by law.
7. Limitation of Liability
PMSoftware Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.
8. Service Level Agreement
Specific service level agreements, including uptime guarantees, response times, and performance metrics, will be detailed in individual service contracts. We strive to provide:
- 24/7 monitoring for critical systems
- Rapid response to urgent issues
- Regular system maintenance and updates
- Proactive security monitoring
9. Termination
Either party may terminate services with appropriate notice as specified in the service agreement. Upon termination, we will provide reasonable assistance in transitioning services and returning your data in a usable format.
10. Governing Law
These terms shall be governed by and construed in accordance with applicable local laws. Any disputes arising from these terms or our services shall be resolved through binding arbitration.
11. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
